WTO’s Dispute Settlement Body has worked upon Vietnam’s request to set up a jury for reviewing the U.S anti-dumping measures on frozen shrimp imported from Viet Nam. It is the first time Vietnam has requested such thing after its entry into WTO. Vu Dung, Head of Viet Nam Permanent Delegation in the United Nations, WTO and other international organization in Geneva, said that the main issue involved in our request is for the panel is the issue of zeroing.
He added that this issue has already been decided by WTO panels and the Appellate Body on various occasions; yet the US has failed to implement the reports… and has continued to apply zeroing in administrative reviews, including those applied to products of Viet Nam.
The report says that U.S. also conducted two other activities, which according to the U.S. laws, will prevent it from abolishing application of anti-dumping measures. The US continuously denied requirement for investigation from Viet Nam’s exporters. In fact, the U.S. could not find the dumping margin in the first, second, and third reviews on the companies under investigation, however, it kept on applying dumping margin on the companies that were not investigated despite their requirement for investigation.
